Mailerday has the right to terminate your account or cancel any email service without telling you about that. Please ensure compliance with all guidelines and terms of service. We won’t be responsible to you or anyone else for stopping your access on Mailerday.

You promise to train and monitor anyone who using Mailerday and agree not to

Send unlawful, harmful, or objectionable content
Uploading unnecessary personal data
Pretend to be someone else
Manipulate identifiers to hide the origin of your content
Infringe on anyone’s rights
Send content you don’t have the right to send
Violate electronic communication laws or relevant codes of practice

In case Mailerday finds someone who affects any of our services then you reserve the right to terminate its account.

Warranties

Our services come as they are, with no guarantees, whether express or implied. We can’t promise that our services will always be perfect or free of errors. We are not responsible for any damages that may happen when you use our services, including direct, indirect, incidental, consequential, or punitive damages.

We are not responsible for any errors or damages caused by you. If you hired our email marketer or experts then it is our responsibility to ensure data security, maintaining transparency, and user info.

Limitation of Liability

Mailerday and its team will not be responsible for any damages including direct, indirect, incidental, consequential, or punitive damages, related to your use of our services. We don’t make any promises about the materials, goods, and services advertised by our partners.

Using the internet and other communication tools involves risks and you accept full responsibility for these risks when using Mailerday. We use major internet service and network providers to deliver emails but we’re not responsible for the final delivery to the recipient’s inbox.

We are not responsible for things like loss of profits, goodwill, use, data, or other intangible losses, resulting from

(i) being unable to use our services,
(ii) unauthorized access or changes to your transmissions or data
(iii) Statements of any third party on our site
(iv) any other matters related to our services.

GST & Texas

Every individual will have to pay an additional 18% GST charge on the total amount. No matter which service they opt for including email campaigns, SMTP service, dedicated server, email verification, Mautic installation, etc.

Dispute Resolution. Jurisdiction

If you have any disagreement or issue related to this Agreement, both you and the Mailerday team will make reasonable efforts to resolve it. We will negotiate to find the right solution that is accepted by both parties.

If any legal action is required, the Courts of Jaipur, Rajasthan(India), will have jurisdiction over all disputes and matters related to the execution, interpretation, enforcement, and termination of this Agreement. The laws of India will govern these Terms of Service and any other related documents entered into by the parties.

Changes to the TOS

At Mailerday, We reserve the right to change or update any of these terms at any time, and we won’t give you notice. If we make any changes, your ongoing use of Mailerday services means you accept the new terms. Keep an eye on the terms regularly to stay informed.

Refund Policy
